Housewife wins HIV-contamination suit against govt
By EMBUN MAJIDALOR STAR: A former Quran teacher, who sued the Government over the HIV-contaminated blood she received during a transfusion seven years ago at Jitra Hospital, has been awarded RM450,000. High Court deputy registrar Ruzita Md Lazim awarded Bashah Mustaffa, 54, the amount in chambers Tuesday.
Bashah, her husband Abdul Halim Abdul Hamid, 52, and their four children had originally sought RM100mil in damages in their suit against Jitra Hospital director and three others in 2000. IMHO in principle there should be an award of punitive damages beyond the mere RM450,000. Will the award be the same had she been a politician's wife? What amount will cause justice to be served? Say, if 100 million is awarded, who will bear the cost? Shouldn't they look for the person who donated the tainted blood (in a typical ACA-in-judiciary video-investigation fashion)? What have we learnt from this?
7 years of waiting, all that time and money spent & the emotional turmoil- and she gets RM450,000. I wonder what's the value of justice these days...
